Please read these Terms of Service ("Terms") carefully before using Evolv. By creating an account or using the platform, you agree to be bound by these Terms. If you do not agree, do not use the service.

1. About the Service

Evolv provides software tools that help you understand your credit report, identify potential inaccuracies, generate dispute correspondence, and track your credit repair progress. Evolv also connects consumers with independent credit repair specialists.

Evolv is a software tool, not a law firm, and does not provide legal advice. Nothing in the platform or these Terms constitutes legal, financial, or credit counseling advice.

2. Consumer Rights Under the Credit Repair Organizations Act (CROA)

Federal law requires that we provide you with the following disclosure before you enter into any contract for credit repair services:

You have a right to dispute inaccurate information in your credit report by contacting the credit bureau directly. However, neither you nor any credit repair company or credit repair organization has the right to have accurate, current, and verifiable information removed from your credit report. The credit bureau must remove accurate, negative information from your report only if it is over 7 years old. Bankruptcy information can be reported for 10 years.

You have a right to obtain a copy of your credit report from a credit bureau. You may be charged a reasonable fee. There is no fee, however, if you have been turned down for credit, employment, insurance, or a rental dwelling because of information in your credit report within the preceding 60 days. The credit bureau must provide someone to help you interpret the information in your credit file. You are entitled to receive a free copy of your credit report if you are unemployed and intend to apply for employment in the next 60 days, if you are a recipient of public welfare assistance, or if you have reason to believe that there is inaccurate information in your credit report due to fraud.

You have a right to sue a credit bureau or credit repair organization that violates the Fair Credit Reporting Act or the Credit Repair Organizations Act.

You have a right to cancel your contract with any credit repair organization for any reason within 3 business days from the date you signed it.

Credit bureaus are required to follow reasonable procedures to insure maximum possible accuracy of the information concerning the individual about whom the report relates. For further information contact:

3. Your Right to Cancel — 3 Business Days

If you sign up for a paid Evolv subscription, you have the right to cancel this agreement, without penalty or obligation, at any time within 3 business days from the date you sign up.

To cancel within the 3-day window, email us at cancel@evolvcrm.com with your name, email address, and account information. We will issue a full refund of any amounts charged within the 3-day period.

After the 3-day cancellation window, you may cancel your subscription at any time from your account dashboard. Cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused days in the final billing period.

Evolv makes no guarantee, express or implied, that use of the platform will improve your credit score, result in the removal of any specific item from your credit report, or achieve any particular credit-related outcome.

Credit bureau decisions are made by the bureaus independently. Dispute outcomes depend on many factors outside our control, including whether the information being disputed is accurate. We provide tools to help you identify and dispute potential inaccuracies — we cannot guarantee the bureau will remove any item.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@evolvcrm.com if you suspect unauthorized access.

You must be at least 18 years of age to create an account and use Evolv.

8. Intellectual Property

Evolv and its content, features, and functionality are owned by Evolv and are protected by copyright, trademark, and other intellectual property laws. You may not copy, distribute, or create derivative works from any part of the platform without our written permission.

You retain ownership of any credit report data and personal content you upload to the platform.

9. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EVOLV SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOSS OF DATA, OR LOSS OF GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE PLATFORM SHALL NOT EXCEED THE AMOUNTS YOU PAID TO EVOLV IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold Evolv, its officers, directors, employees, and agents harmless from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the platform, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms or applicable law. You may terminate your account at any time by contacting support or using the account closure option in your settings.

13. Governing Law and Disputes

These Terms are governed by the laws of the United States and the state in which Evolv is incorporated, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the platform shall be resolved through binding arbitration rather than in court, except that either party may bring claims in small claims court.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a notice on the platform at least 14 days before the change takes effect. Your continued use of the platform after that date constitutes your acceptance of the updated Terms.
